Welcome to THE K-BEAUTY VAULT.

The K-Beauty Vault is operated by SHAMMY GROUP PTY LTD (ABN 74 693 714 975), a business based in New South Wales, Australia.

In these Terms of Service, the terms “we”, “us” and “our” refer to The K-Beauty Vault and SHAMMY GROUP PTY LTD. The terms “you” and “your” refer to any visitor, customer or user of our website and services.

We operate this online store and website, including all related information, content, features, products and services, in order to provide customers with a curated K-beauty shopping experience. Our online store is powered by Shopify.

These Terms of Service, together with our Privacy Policy, Refund Policy and Shipping Policy, explain the conditions that apply when you browse our website, create an account, place an order or otherwise use our services.

By accessing or using our website or purchasing from us, you agree to these Terms of Service. If you do not agree with these Terms, you should not use our website or services.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.


SECTION 1 – ELIGIBILITY AND ACCOUNTS

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order through our store.

When using our website or placing an order, you agree to provide information that is accurate, current and complete. This may include your name, email address, billing information, delivery address and payment information.

If you create an account, you are responsible for keeping your login details secure and for activity carried out through your account. Please contact us promptly if you believe your account has been accessed without permission.

You must not transfer, sell or provide your account to another person without our written permission.

However, product colours and appearance may vary slightly depending on your screen, device settings, lighting and photography. Packaging, labels or product presentation may also change where a manufacturer updates a product.

Where there is a material difference between the product information shown on our website and the product supplied, please contact us before using the product.

Cosmetic ingredients and formulations may be updated by manufacturers. Customers should check the ingredient list and directions shown on the product packaging before use, particularly if they have allergies, sensitivities or known reactions to cosmetic ingredients.

Placing an order through our website is an offer to purchase the selected products.

• the delivery information is incomplete or appears incorrect;
• we reasonably suspect fraud, unauthorised activity or misuse;

• an order exceeds reasonable purchase limits; or
• we are legally unable to supply or deliver the order.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled products to the original payment method.

We may contact you using the email address, telephone number or billing information supplied with your order if we need to confirm or correct any order details.

Please review your order carefully before submitting it. Requests to change or cancel an order are subject to our Refund Policy and may not be possible once processing or dispatch has begun.

Products purchased through our retail store are intended for personal or household use unless we agree otherwise in writing.


SECTION 4 – PRICES, TAXES AND PAYMENT

All prices displayed on our website are in Australian dollars (AUD).

Displayed prices include any mandatory taxes that apply to the sale unless otherwise clearly stated. Delivery charges and any optional charges will be shown before you complete your purchase.

We may change product prices at any time, but a price change will not affect an order that we have already accepted, except where there has been an obvious or material pricing error.

If a material pricing error is discovered after you place an order, we will contact you and give you the option to:

• proceed at the correct price; or
• cancel the affected item and receive a refund.

You agree to provide accurate and authorised payment information. By submitting payment details, you confirm that you are authorised to use the selected payment method.

Payments are processed by Shopify Payments or other payment providers offered at checkout. We do not directly store complete credit card numbers.

Your order may be delayed or cancelled if payment cannot be authorised, verified or successfully processed.


SECTION 5 – PROMOTIONS AND DISCOUNTS

From time to time, we may offer discount codes, promotional prices, free gifts, bundles or other special offers.

Promotions may be subject to separate conditions, including:

• start and end dates;
• minimum purchase requirements;
• product exclusions;
• limits per customer or order;
• restrictions on combining discounts; and
• stock availability.

Unless otherwise stated, promotional offers cannot be applied retrospectively to orders that have already been completed.

We may withdraw or amend a promotion before an order is accepted where there is a genuine error, technical issue, suspected misuse or stock limitation. This does not affect any rights that cannot lawfully be excluded.


SECTION 6 – SHIPPING AND DELIVERY

We deliver to the locations made available at checkout.

Delivery timeframes shown on our website are estimates only. Actual delivery times may be affected by carrier delays, weather, public holidays, incorrect delivery details, high order volumes or other circumstances outside our reasonable control.

We will take reasonable steps to dispatch orders within the stated processing period.

If an order is significantly delayed, lost or damaged during delivery, please contact us at support@thekbeautyvault.com so that we can investigate and provide an appropriate solution.

Where a product cannot be supplied or delivered within the agreed timeframe or within a reasonable timeframe, available solutions may include a replacement, redelivery or refund, depending on the circumstances and applicable law.

You are responsible for providing a complete and accurate delivery address. We are not responsible for a failed delivery caused solely by an incorrect or incomplete address supplied by you. Additional delivery costs may apply if an order must be resent because incorrect delivery information was provided.

Risk of loss or damage remains with us until the products are delivered to the delivery address or authorised recipient, except to the extent that loss or damage results from your incorrect address, unsafe delivery instructions or another matter within your control.

SECTION 7 – RETURNS, REFUNDS AND CONSUMER RIGHTS

Change-of-mind returns, order cancellations and other voluntary returns are managed in accordance with our Refund Policy.

Our Refund Policy does not limit any rights or remedies available under the Australian Consumer Law.

Products sold to consumers must comply with the consumer guarantees that apply under Australian law. Depending on the nature and seriousness of a product failure, customers may be entitled to a repair, replacement, refund or compensation for reasonably foreseeable loss or damage.

We will not refuse a remedy that a customer is legally entitled to receive because:

• a stated return period has ended;
• the product was purchased during a promotion;
• the original packaging has been opened where opening it was reasonably necessary to identify a fault; or
• the customer does not have the original receipt but can provide another reasonable form of proof of purchase.

A customer may not be entitled to a remedy where the issue was caused by misuse, failure to follow instructions, accidental damage, normal wear, or a problem that was clearly disclosed before purchase.

• does not contain malware, spam or unauthorised advertising; and
• does not impersonate another person or misrepresent its source.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, format and share submitted content for the operation and promotion of our store, products and services.

We may moderate, decline or remove user content where we reasonably believe it breaches these Terms, applicable law or the rights of another person.

We will not knowingly publish fake or misleading reviews or conceal reviews solely because they express a genuine negative opinion.

The K-Beauty Vault is powered by Shopify, which provides the ecommerce platform that enables us to operate our online store.

Purchases made through our store are transactions directly between you and The K-Beauty Vault.

Shopify is not the seller of the products listed by The K-Beauty Vault and is not responsible for fulfilling our orders, providing our customer service or resolving product-related claims between you and The K-Beauty Vault.

Nothing in this section excludes any rights or remedies that you may have against Shopify where Shopify is independently responsible under applicable law.


SECTION 14 – ACCEPTABLE USE

You must use our website and services only for lawful purposes.

You must not:

You and The K-Beauty Vault submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of the Commonwealth of Australia.

Nothing in this section prevents a consumer from exercising any mandatory right or remedy available under the laws that apply to them.


SECTION 22 – SEVERABILITY, WAIVER AND ENTIRE AGREEMENT
